By accessing or using Brainiers Community ("Service", "Platform", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

Brainiers Community is a YouTube creator community platform that facilitates organic engagement exchange between real content creators. Members earn points by engaging with others' content and spend points to receive genuine engagement on their own channels.

3. Eligibility

To use our Service, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction, whichever is higher)
• Have a valid YouTube account in good standing
• Provide accurate, complete, and current registration information
• Not be prohibited from using the Service under applicable law

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

We reserve the right to terminate accounts that violate these Terms, engage in fraudulent activity, or harm the community.

5. Acceptable Use

You agree not to:

• Use bots, scripts, or automated tools to interact with the platform
• Create fake or multiple accounts to gain an unfair advantage
• Submit, upload, or share content that is illegal, harmful, or violates third-party rights
• Harass, threaten, or abuse other community members
• Attempt to reverse-engineer, hack, or compromise the platform's security
• Engage in any activity that disrupts or damages the Service
• Violate YouTube's Terms of Service or Community Guidelines
• Sell, trade, or transfer your account to another person

6. Points System

Points earned on Brainiers Community have no monetary value and cannot be exchanged for cash. Points may only be used within the platform's exchange system. We reserve the right to modify the points system, including point values and redemption rates, at any time.

Points are non-transferable and expire upon account termination or 30 days after subscription cancellation.

7. Subscription and Billing

Paid subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to change subscription prices with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Brainiers Community and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit to the platform. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Service.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee specific results from using the platform, including channel growth metrics. YouTube's algorithm changes may affect the impact of community engagement.

10. Limitation of Liability

To the maximum extent permitted by law, Brainiers Community shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Los Angeles County, California.
